ACCRALAW served as counsel of Smartmatic TIM Corporation and Smartmatic Philippines, Inc. in a Petition for Certiorari win before the Supreme Court.
The petition sought to declare the disqualification of Smartmatic Philippines, Inc. by the Commission on Elections (COMELEC) as void for having been issued with grave abuse of discretion amounting to lack or in excess of jurisdiction.
On 17 April 2024, the Supreme Court reported that the petition had been granted in a decision penned by Associate Justice Jose Midas Marquez. The High Court en banc unanimously ruled that the COMELEC abused its discretion when it “implemented a discretionary pre-qualification regime antithetical to [the] Government Procurement & Reform Act.”
