The 2021 International Chamber of Commerce (ICC) Arbitration Rules National Launch was held virtually last 27 January 2021. The event was organized by ICC Philippines.
Significant revisions to the ICC Arbitration Rules were discussed. An overview was given by ICC Managing Counsel Ziva Filipic and it was followed by presentations and panel discussions.
The panel discussion on The Use of Technologies in ICC Arbitration was led by ACCRALAW’s Senior Partner Patricia-Ann T. Prodigalidad. She presented a summary of the revisions and shared the ICC’s recommendations on protocols for parties to adopt. She concludes that with these revisions it is clear that the ICC embraces digital solutions without sacrificing due process considerations.
Another panel discussion on The Application of Transparency in ICC Arbitration was led by ACCRALAW’s Of Counsel Victor P. Lazatin. He identified the provisions aimed at promoting transparency, including disclosure obligations of arbitrators.
Through the course of the discussion, it was raised that some of the revisions were not new. Some in fact codified certain practices commonly used or even clarified current practices.
Mr. Lazatin and Ms. Prodigalidad are among the leading arbitration practitioners, both as arbitrators and advocates, in the Philippines. They have a wealth of experience in domestic and international arbitration, including the specialized field of construction arbitration.
