Firm’s Business Process Outsourcing

The Firm’s Labor & Employment Department (LED) regularly assists companies in the outsourcing industry, such as those engaged in business process outsourcing (BPO), Knowledge process outsourcing (KPO), information technology and business process management (IT-BPM), managed services, and other outsourcing business models and arrangements.

LED is frequently called on to represent and defend clients against claims for illegal dismissal, unfair labor practices, employment-related monetary claims, and other employee relations and labor standards issues before the National Labor Relations Commission and its Labor Arbiters, the Department of Labor and Employment and its attached agencies, the Court of Appeals, and the Supreme Court.

LED and its lawyers also advise companies in the outsourcing industry on a gamut of labor and employment matters that covers the full employment life cycle and other related issues that arise from outsourcing arrangements. This includes, among others, preparation and review of contracts, workplace policies, workforce optimization and structuring, compensation and other benefits, occupational safety and health standards, assistance in collective bargaining agreement negotiations, regulatory inspections, employee discipline, and post-employment matters.

To keep abreast of developments in the outsourcing industry, LED and its lawyers actively participate in professional organizations and industry groups such as the Management Association of the Philippines, People Management Association of the Philippines, and the Employers Confederation of the Philippines. Through these organizations, LED and its lawyers also participate in meetings and/or deliberations before relevant committees of the Philippine Senate and/or House of Representatives concerning proposed legislations that affect the outsourcing industry.

LED’s expertise and deep understanding of the commercial realities of outsourcing operations enable it to provide legally compliant, meaningful, and practical advice to clients.
